Upon placing your order, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Acceptance of your order and the formation of a contract of sale of the product(s) between you and us will not take place unless and until full payment is provided and upon you receiving a confirmation from us that the product(s) have been shipped to you from our warehouse.

All products shown on the Website are subject to availability. Although we strive to ensure the Website accurately reflects the available stock, a product displayed on the Website may no longer be available.

In the event of conflicting purchases due to insufficient stock, FILA Malaysia has the right to forfeit any customer of the purchase. We will inform you by way of email and proceed to refund any payment(s) made.

Where the Product(s) are shown on the Website but are not or no longer available;

Where the Product(s) displayed on the Website contains a manifest error such as being incorrectly priced or otherwise incorrectly described;

Where we are unable to obtain authorization for payment or the payment process is incomplete.

We reserve the right to cancel your order after the creation of the contract of sale, thereby terminating the contract of sale. Following such cancellation, we will provide a full refund of the amount paid under the cancelled order.

All Product(s) sold through our Website shall remain the property of FILA Malaysia until you have paid all amounts owed to us in full under any contract of sale. You may not sell, dispose of or encumber any Product(s) before full title thereof has passed to you.

FILA Malaysia has and fully reserves the right to refuse to accept any order that, it knows or reasonably suspects, was made with the assistance or involvement of any software, robot, crawler, spider or other automated means or device.

We reserve the right to possible typographical errors relating to the product description, pricing, and availability. Minor differences in colour and other variations in the product(s) are possible as a result of different image acquisition, display technologies or other technical reasons.  

We may cancel an order where the product(s) displayed on the Website contains a manifest error (i.e. incorrect pricing/product description) and/or an incorrect stock balance.

We reserve the right to invoke force majeure in situations where we are prevented from delivering the product(s) due to circumstances beyond our or our suppliers’ control (for example, in the event of a war, extreme weather conditions, power or network outages, work strike or blockade). In such situations, we shall have the right to postpone the fulfilment of the delivery. We will promptly notify you by way of email of the obstacle directly and how it affects the ability to perform according to the agreement. If such notice is not given within a reasonable time after we have become aware of or ought to have become aware of the obstruction, we are obliged to pay compensation for the damage that you could have avoided if the notice was delivered in a timely manner.

You are prohibited from using any software, robot, crawler, spider, page scraper or any other automated means or device to (a) access, copy, affect or monitor any part of the Website or its content or circumvent the structure or presentation of the Website or any of its content or (b) to interfere with the operation of the Website or any transaction being made on the Website or interfere or affect any person’s use of the Website or to help facilitate any third party to purchase any product on the Website.

These Terms of use shall be governed by and construed in accordance with the laws of Malaysia. Any dispute which may arise under these Terms shall be under the exclusive jurisdiction of the Courts of Malaysia.
